It will not always be clear, for example, who is to be responsible for such aspects. It might be reasonably supposed that childcare will fall under the remit of social workers. They, however, will have to ensure that directions given comply with the Children Act. Who sorts out care of a pet, however, may fall to the most animal-loving member of staff. Taking a patient’s credit cards away from them, even if in an advance directive, may not seem an appropriate part of the duties of most clinical staff.

It should also be noted that nowhere does an advance directive, even if legally binding, expect a doctor to provide any treatment, including medication, against their clinical judgement. It is highly unlikely that a point will be reached where patients will be allowed to demand and receive whatever treatment they choose. A third reason may have to do with the imposed responsibility on the doctor in caring for someone who is refusing treatment, and was highlighted in the study by Atkinson, Garner and Gilmore (2003b).

Someone, however, could refuse treatment when well and then want to take it when ill and unable to make a capacitous decision to consent. The treating doctor may then choose to over-ride the advance directive if it were then possible to treat the person under mental health legislation. Some may also choose to treat the patient even if not under compulsory powers on the grounds that it is in the patient’s best interests. An advance agreement to treatment, however, puts the former, capacitous person at odds with the present, non-capable person who is now refusing treatment.
